This Privacy Policy describes how Everest™ ("Everest," "Company," "we," "us," or "our") collects, uses, processes, and discloses information in connection with access to and use of the Everest platform and related products, including VINReveal™, QUICKCompare™, QUICKClick™, and SECURELink™ (collectively, the "Services"). This Privacy Policy applies to business users of the Services and reflects Everest\u2019s practices with respect to information processed in the course of providing the Services.
1. Scope and Context
The Services are provided as a business-to-business platform for use by automotive professionals, including repair facilities, insurers, and related entities. Everest is not a consumer-facing platform and is not intended to serve as a system of record for consumer personal information.
2. Information We Collect
In connection with operation of the Services, Everest collects and processes certain categories of information.
This includes information provided directly by users, such as account registration details, including names, email addresses, company names, and related business contact information.
Everest also collects vehicle-related information submitted through the Services, including vehicle identification numbers (VINs) and associated vehicle data necessary to generate Outputs.
In addition, Everest automatically collects technical and usage information generated through interaction with the Services. This may include internet protocol (IP) addresses, browser type, device information, system activity, access timestamps, usage patterns, and log data.
The Services also utilize session-based technologies, including cookies or similar mechanisms, necessary to support authentication, session management, security, and platform functionality.
3. Information Submitted by Customers (Including Estimates)
Customer acknowledges that information submitted to the Services, including estimates, documentation, or related materials, may contain personal information relating to third parties, such as vehicle owners or claim participants.
The Services are not intended to store or manage such information. To the extent such information is submitted, Everest processes it solely as necessary to provide the Services and does not use such information for independent purposes.
Everest does not intentionally retain consumer personal information beyond what is necessary for transient processing, system functionality, security, logging, or as otherwise required for legitimate business operations.
Customer is solely responsible for ensuring that it has the legal right to submit any information to the Services and that such submission complies with applicable laws and contractual obligations.
4. Use of Information
Everest uses information collected through the Services for legitimate business purposes, including operating, maintaining, and improving the Services; generating Outputs; supporting platform functionality; enhancing system performance; monitoring usage; detecting, preventing, and investigating misuse; enforcing contractual rights; and maintaining system security and integrity.
Information may also be used in aggregated or de-identified form to analyze trends, improve workflows, and refine system logic.
5. Disclosure of Information
Everest does not sell customer data.
Everest may disclose information to third-party service providers that support the operation of the Services, including providers of hosting, infrastructure, data storage, analytics, and security services, subject to appropriate confidentiality obligations.
Everest may also disclose information where required to do so by law, regulation, legal process, or governmental request, or where Everest determines that disclosure is necessary to protect its rights, enforce agreements, or prevent harm to the Services, users, or others.
6. Data Retention
Everest retains information for as long as reasonably necessary to operate the Services, fulfill contractual obligations, maintain system integrity, comply with legal requirements, resolve disputes, enforce agreements, and maintain backups and audit records.
7. Data Security
Everest implements commercially reasonable administrative, technical, and physical safeguards designed to protect information under its control, including encryption in transit, access controls, and system monitoring.
Notwithstanding the foregoing, no method of transmission or storage is completely secure, and Everest does not guarantee absolute security.
8. User Responsibilities
Customer is responsible for maintaining the confidentiality of account credentials and for all activities conducted under its accounts.
Customer is further responsible for ensuring that any information submitted to the Services, including any personal information, is lawfully obtained and may be processed by Everest in accordance with these Terms and applicable law.
Customer agrees not to use the Services to store or process sensitive personal information except where necessary and authorized.
9. Data Rights and Requests
To the extent required by applicable law, individuals may have certain rights with respect to their personal information, including rights to access, correct, or request deletion of such information.
Requests may be submitted using the contact information below, and Everest will respond in accordance with applicable legal requirements.
10. Third-Party Services
The Services rely on third-party infrastructure and service providers. Everest is not responsible for the privacy practices of such third parties, except as required by applicable law.
11. Changes to This Policy
Everest reserves the right to modify this Privacy Policy at any time. Continued use of the Services following any such changes constitutes acceptance of the updated Policy.
